This myth pops up a lot online but it’s not true. It appears to be based on a misreading of a section of Nathaniel Hawthorne’s The Scarlet Letter where the narrator describes an old wharf in Salem: "From the loftiest point of its roof, during precisely three and a half hours of each forenoon, floats or droops, in breeze or calm, the banner of the republic; but with the thirteen stripes turned vertically, instead of horizontally, and thus indicating that a civil, and not a military post of Uncle Sam’s government is here established."
The flag he’s talking about here is the customs service ensign, which actually has sixteen vertical stripes and the Great Seal of the United States in the canton. Hawthorne presumably would have seen the flag when he was working at the Boston Custom House in the 1830s. There’s no historical evidence that the civil flag as depicted above ever existed before its online “rediscovery” in the early 2000s.
Also the term “civil flag” doesn’t mean a flag flown by a civilian government or a flag flown in peacetime but rather a flag that’s allowed to be flown by anyone (as opposed to a state flag which is reserved for government use). Most countries outside of Europe and Latin America don’t have separate state and civil flags.
